When doing business we can hardly imagine our activity without rent: everything is for rent – offices, warehouses, buildings, constructions, land plots, equipment, transport, housing – and this list is not complete. If you are a tenant, you should know that you have a right to extend the rental period for a new term. The applicable law stipulates that, unless otherwise provided by the law or rental contract, the tenant that duly performed his obligations after the expiration of the rental period has a priority right to enter the rental contract for a new term. One should know that the tenant must give written notice to the landlord of the intention to extend the contract in a timeframe indicated in the rental contract or, if this timeframe is not indicated, in a reasonable timeframe before the expiration of the contract.

If the landlord refused to extend the contract with the tenant for a new term, but, within a year from the expiration of the contract with the tenant, entered a rental contract with a third party, the tenant is entitled to choose between claiming in court the assignment of rights and obligations under the new contract and the compensation of losses, incurred by the refusal to extend the rental contract therewith, or solely the compensation of losses. If the tenant continues using the property after the expiration of the contract with no objections by the landlord, the contract is deemed to be extended on the same terms and for an indefinite period.

A seemingly simple issue of extension of the rental contract may involve a litigation and a headache: often, it is not profitable for the landlord to extend the contract with the tenant, therefore there are a lot of unjustified refusals to extend the rental contracts, which is a violation of the tenant’s rights.
